Bayne, MSgt. 1st Squadron, Special Operations Training Force (SOTF) Fort Bragg,NC Mother-in-law: Brenda P. Caudle, PO Box 1944 Hendersonville, NC. 28739 Father-in-law: Bruce S. Bayne, 884 Toxaway CT. Hendersonville, NC. 28739 I’m requesting a compassionate re-assignment to be stationed at Fort Bragg, NC. or Fort Lee, Va. for these stressful reasons. I had been deployed here at Kandahar, Afghanistan since 12 March 2010, and this is suppose to be a one year rotation. 1. I had filed for a spousal separation on 3rd of January 2008, and attended the briefings at 18th Airborne JAG, Fort Bragg, NC. because of an on-going marital problems. And my husband back then (Ryan W. Bayne) immediately hired a lawyer. By doing that, I had to be out the house, a counselor cannot represent me if we reside in the same household. Also, I was not able to be in the Pro-Bono Program, if I'm being supported by him and reside at the same address. 2. When the court order was issued by his lawyer, I had stayed at the Women’s Homeless shelter at Fayetteville, NC. Because I don’t have any family in NC., and to be able to appear in the court proceedings. The case is under Hoke County, NC. jurisdiction. 3. The finalization of the divorce order which had taken place while I was stationed at Fort Carson , Colorado had put so many burden on me financially and emotionally. 4. I lost custody of my children because I was not’t able to appear in the court proceedings in NC., and I had ran out of money for the lawyer’s funds to appeal in any more proceedings. 5. Most of the court appearances were scheduled while I was in the military orders for training. 6. I intend to appeal back in court to get a legal and joint custody of my three minor children. 7. I am still entitled in my parental rights, and my children’s visitations. 8. And I will need to have a financial assessment due to my financial issues: a. Child-Support b. Credit Cards Debts c. Vehicle Payments d. Federal Student Aid (I was registered in class, but incomplete/ I was at NTC, California ) e. Lawyer's Funds I need this compassionate re-assignment to alleviate these on-going financial, emotional and personal issues . In conclusion, I am entitled to appeal my parental rights. And I have to reside close to the county, because it's under NC. jurisdiction. |
